MotoMind Terms and Conditions

1. Acceptance of Terms

By creating an account, accessing, or using MotoMind, you agree to these Terms and our Privacy Policy. If you do not agree, do not use MotoMind.

2. Eligibility and Account Registration

You must be legally able to form a binding agreement in your jurisdiction. You are responsible for providing accurate account information, safeguarding account credentials, and all activity under your account.

3. Service Description

MotoMind provides tools for:

• dirt bike records management;
• VIN entry and reference outputs;
• maintenance schedules, reminders, and calendar sync;
• service document upload, OCR parsing, and maintenance history logging;
• bike transfer workflows and continuity of records.

4. User Content and License

You retain ownership of content you submit, including maintenance logs, photos, PDFs, and notes. You grant MotoMind a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display your content solely to operate, secure, and improve MotoMind and deliver requested functionality.

You represent and warrant that:

• you own or have all rights required to submit the content;
• your content does not violate law, third-party rights, or these Terms.

5. Acceptable Use

You may not:

• upload unlawful, infringing, abusive, fraudulent, or malicious content;
• attempt unauthorized access, reverse engineering, or service disruption;
• use MotoMind to violate law, privacy, or intellectual property rights;
• misrepresent ownership history, service history, VIN status, or bike identity.

We may suspend, limit, or terminate accounts for violations.

6. VIN, Reference Data, and Technical Information Disclaimers

MotoMind may display information from third-party databases, recall endpoints, manuals, or provider integrations. Such information may be incomplete, delayed, or unavailable.

You must independently verify critical data before purchase, sale, repair, torque application, or safety-related decisions. If official specifications are unavailable, MotoMind may provide fallback or recommended data and will label those outputs accordingly.

7. Maintenance and Safety Disclaimer

MotoMind is an informational and record-management tool. MotoMind does not provide professional mechanical, engineering, inspection, safety, legal, or financial advice. You assume all risk for maintenance, riding, purchase, sale, and repair decisions.

8. Calendar, Notification, and Device Features

Calendar, push notifications, camera/photo access, and related features depend on device permissions and platform services. MotoMind is not liable for missed reminders, delayed events, denied permissions, or platform outages.

9. Availability and Modifications

We may modify, suspend, or discontinue features at any time. We may issue patches, updates, and security fixes. Continued use after updates constitutes acceptance of updated functionality and policies.

10. Intellectual Property

MotoMind, including app content, software, marks, logos, and design elements, is protected by intellectual property law. Except as expressly granted, no rights are transferred to you.

11. Feedback

If you submit feedback or ideas, you grant MotoMind a perpetual, irrevocable, worldwide, royalty-free right to use and incorporate that feedback without compensation.

12. Termination

You may stop using MotoMind at any time. We may suspend or terminate access for violation of these Terms, legal risk, security risk, or service integrity concerns. Certain provisions survive termination, including intellectual property, disclaimers, limitations of liability, indemnity, and dispute provisions.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTOMIND IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPLETELY ACCURATE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTOMIND AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO MOTOMIND WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

15. Indemnification

You agree to defend, indemnify, and hold harmless MotoMind and its affiliates from claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from or related to:

• your use of MotoMind;
• your content;
• your violation of these Terms or law;
• your infringement of any third-party rights.

16. Governing Law and Venue

These Terms are governed by the laws of Texas, United States, without regard to conflict-of-law rules. Unless otherwise required by mandatory law, disputes shall be brought exclusively in state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction and venue in those courts.

17. Changes to Terms

We may revise these Terms periodically. If changes are material, we will provide reasonable notice. Continued use after the effective date of revised Terms constitutes acceptance.

19. Platform Availability

MotoMind is available globally on the web at motomind.app and on iOS and Android app marketplaces, subject to local availability, legal restrictions, and platform terms.
